1. Scope

These Terms and Conditions apply to all services provided through the AI Car Studio platform (aicarstudio.org). By using the service, the user accepts these terms in full.

2. Service Description

AI Car Studio is a web-based service that uses Artificial Intelligence (AI) to automatically edit vehicle photos and create professional listing images. Image generation is performed via third-party AI APIs. A specific result or image quality cannot be guaranteed.

3. Registration and User Account

Certain features require registration. The user is obliged to provide accurate information and to keep their login credentials confidential. Each person or entity may only create one account. Multiple registrations to circumvent usage limits are prohibited.

4. Prices and Payment

Prices are displayed and charged in the currency of the respective country (e.g. CHF, EUR, USD) and include any applicable taxes. The amount shown during checkout is binding. Billing is handled by the payment provider Stripe.

Listing Pack: One-time payment for 6 credits (1 credit = 1 image generation or removing the watermark of one test image; non-transferable, no expiry)
Booster Package: One-time payment for 20 credits (1 credit = 1 image generation or removing the watermark of one test image; non-transferable, no expiry)
Pro Flat Rate: Monthly subscription with up to 500 image generations per month; cancellable at any time at the end of the month

4.1 Free Test Images

Each person can create a total of 3 free test images, also without registration. Without signing in, a maximum of 15 test images per network connection is possible.
Test images carry a watermark (“aicarstudio.org”) and may only be used to evaluate the service.
Downloading requires signing in. Removing the watermark costs 1 credit per image and requires the purchase of a package.
Test images and their originals are stored for 30 days; after that they can no longer be unlocked.
There is no entitlement to free test images; the provider may change or end this offer at any time.

5. Right of Withdrawal and Refunds

Since digital content is provided immediately, no statutory right of withdrawal applies, provided the user has expressly agreed to immediate execution. Refunds may be granted on a case-by-case basis at the provider's discretion, particularly in the event of technical errors.

6. Disclaimer of Liability

The provider accepts no liability for:

The quality, suitability or accuracy of AI-generated images
Interruptions, errors or failures of the service
Data loss or damage arising from use or non-use of the service
Actions or content of third-party providers (Stripe, Google, Firebase)
Indirect damages, loss of profit or consequential damages of any kind

7. Usage Rights

Upon payment, the user receives a simple, non-transferable right to use the generated images commercially. The provider reserves the right to use anonymised images to improve the service, unless explicitly prohibited. Test images with a watermark may only be used to evaluate the service; commercial use requires the paid removal of the watermark.

8. Prohibited Use

It is prohibited to use the service for the following purposes:

Creating misleading, fake or fraudulent content
Automated access (bots, scraping)
Circumventing usage limits through multiple registrations or otherwise circumventing the test image limits
Reselling the service without explicit authorisation

9. Changes to the Terms

The provider reserves the right to change these terms at any time. Users will be informed by email or by a notice on the website. Continued use of the service constitutes acceptance.

10. Governing Law and Jurisdiction

Swiss law applies exclusively. The place of jurisdiction is the registered office of the provider.
